What workers' compensation lawyers handle

On the claimant side, a lawyer files or reopens the claim, gathers medical records and wage statements, arranges an independent medical evaluation when the insurer's doctor disagrees with the treating physician, and represents the worker at mediation and at hearings before an administrative law judge or the state board. The aim is payment of medical care, temporary disability benefits and a fair rating or settlement for lasting impairment.

On the defense side, firms represent employers, self-insured groups and insurance carriers. They investigate whether an injury arose out of employment, challenge excessive treatment or disability claims, coordinate surveillance where fraud is suspected, negotiate settlements and appeal adverse rulings. Many also advise on overlapping issues: a retaliation claim after termination, a third-party negligence suit against a contractor, or ADA and FMLA duties that run alongside comp.

Claimant engagements run from intake to award or settlement; defense work is often assigned case by case from an insurer's panel or billed to the employer per matter.

A workers' compensation lawyer handles disputed workplace injury claims: filing, gathering medical and wage evidence, negotiating with the insurer and representing a party at hearings and appeals. Some represent injured employees, while others defend employers, self-insured companies and carriers.

Lawyers for injured workers usually charge a contingency fee capped by state law and approved by the judge or board. Defense counsel bills employers or insurers hourly or by flat fee. Most firms here list no minimum; a few start at $1,000 or $5,000.

An employer should bring in defense counsel when a claim is contested, a hearing is scheduled, fraud is suspected, or the claim overlaps with a termination, retaliation complaint or third-party lawsuit. If the carrier assigns panel counsel, confirm who directs strategy and settlement decisions.

Workers' compensation is a no-fault system: an injured employee receives set benefits without proving the employer was negligent, and usually cannot sue the employer. Personal injury law covers fault-based claims, such as a suit against a negligent contractor whose equipment caused the injury.
